Welcome to Tsubacheck. These Terms and Conditions of Use (“Terms”) govern your use of the services and products offered by Tsubacheck (“we”, “us”, “our” or “the Company”) through our website and mobile application (“Platform”).

Acceptance of Terms

By accessing or using our Platform, you accept and agree to be bound by these Terms. If you do not agree to any of the terms set forth herein, you may not use our services.

Services offered

Tsubacheck offers services and products through its Platform, which include, among others, the Tsubacheck Honor plans that allow the user the possibility to make daily logs and generate reports of those logs.

Licensing and cancellation of subscription

Users who purchase a subscription to Tsubacheck services are granted a limited, non-exclusive license to use such services in accordance with these Terms. However, we reserve the right to terminate or modify these licenses at any time, without notice and for any reason.

Renewal and payment

Subscriptions to our Tsubacheck Honor service plans can be automatically renewed according to the terms of the contracted plan. The user may continue to enjoy the contracted plan until the scheduled renewal date. No refunds will be made for cancellations made during the subscription period.

Modification of plans

Users have the option to upgrade to a Tsubacheck Honor plan with more services at any time. In this case, a pro-rated fee will be applied between the previous Tsubacheck Honor plan and the new one until the renewal date, when the full amount of the new Tsubacheck Honor plan will be paid. A plan downgrade is not permitted.

Conditions upon cancellation

Users who cancel their Tsubacheck Honor subscription before the end of the billing period will not be able to generate reports for that period, but will be able to download reports generated prior to cancellation. In addition, users without an active Tsubacheck Honor plan will not be able to perform check-ins or generate new reports, but will be able to access the application.

Accumulation of records

In the case of monthly paid Tsubacheck Honor subscriptions, unused registrations in one month will be accumulated for the next billing period. However, this does not apply to annual Tsubacheck Honor subscriptions, where unused records will not be accumulated.

Intellectual Property

All intellectual property rights in the Platform and its content are owned by Tsubacheck. Users may not copy, modify, distribute, transmit, display, publish, sell, license or otherwise exploit any content without the prior written consent of the Company.

Limitation of liability

To the maximum extent permitted by law, Tsubacheck shall not be liable to any user for indirect, incidental, special, punitive or consequential damages, including, without limitation, loss of revenue, profits, data or use, whether in an action in contract, tort (including negligence) or otherwise, even if advised of the possibility of such damages.

General Provisions

These Terms constitute the entire agreement between the User and Tsubacheck with respect to the use of the Platform. Any modification or waiver of these Terms must be in writing and signed by an authorized representative of the Company.

Applicable Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Ppat. d’Andorra, without regard to its conflict of law provisions. Any dispute arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Andorra la Vella, Ppat. d’Andorra.
